Terms of Service

These Terms of Service govern the use of the Paintdeck website, application, API, and account-based services (together, “Paintdeck”). The service is operated by:

The Privacy Notice, Community Guidelines, and Imprint provide additional information. The Community Guidelines form part of these Terms for public content and conduct.

You must be legally able to enter into this contract. If you do not have full legal capacity under the law that applies to you, you may use Paintdeck only with the permission of your legal representative. You may not use Paintdeck if applicable law prohibits you from receiving the service.

The contract for use of Paintdeck is formed when you complete account registration. It runs for an indefinite period. You may browse publicly available website content without an account where Paintdeck makes that possible.

• Provide a valid email address and accurate account information.
• Keep one-time codes, passkeys, devices, and other account access secure, and notify us promptly if you suspect unauthorised use.
• Use only your own account and do not sell, transfer, or share access to it.
• Choose a username and profile information that do not impersonate another person or infringe another person's rights.

Paintdeck provides tools for organising miniature paints, recipes, and projects and for discovering content that painters choose to publish. The specific functions available can depend on the application version, device, operating system, and region.

Paintdeck is currently offered without charge. There is no currently available Premium plan or paid entitlement under these Terms, and references to planned or coming-soon functions are not an offer or a promise that they will be released. If paid plans are introduced later, their features, price, billing period, renewal and cancellation terms will be shown before purchase. A paid plan will not begin without a separate order or other express agreement.

If you obtain the application through an app store, the store's terms also apply to its distribution, downloads, updates, and any store-managed purchase. These Terms govern your relationship with the Paintdeck operator; the app store is not responsible for operating Paintdeck unless its own terms say otherwise.

Use Paintdeck lawfully and with respect for other people and the service.

• Do not upload, publish, or share unlawful content or content prohibited by the Community Guidelines.
• Do not harass others, impersonate a person or organisation, send spam, commit fraud, or misuse reporting and appeal tools.
• Do not access another account, non-public data, or restricted systems without permission.
• Do not introduce malware, disrupt the service, evade security or moderation measures, or place an unreasonable load on the service.
• Do not scrape, harvest, or use automated access except through functionality or interfaces we expressly provide or where mandatory law permits it.
• Do not use Paintdeck or its content to violate intellectual-property, privacy, publicity, or other rights.

You retain your rights in text, images, recipes, projects, profile information, and other content you submit to Paintdeck. You are responsible for your content and must have the rights and permissions needed to store it and, where you choose, publish it.

You grant the operator a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, technically adapt, transmit, and display your content only as needed to operate, maintain, secure, and back up Paintdeck, provide the functions you request, and review content for compliance. Technical adaptations include resizing or reformatting images and creating copies needed for delivery. This licence does not transfer ownership of your content.

For private content, the licence is limited to providing the private service to you and authorised technical processing. When you explicitly publish content, the licence also covers making that content publicly accessible through Paintdeck. We will not use your content in advertising outside Paintdeck without separate permission.

Where Paintdeck expressly offers a copy function for public content, you also permit other account holders to copy and adapt that content within Paintdeck for their own painting workspace. Paintdeck may preserve source attribution. Permission for a copy already made continues after you unpublish or delete the source; it does not allow the recipient to use your original images outside Paintdeck or to claim authorship.

The operator's licence ends when the relevant content is deleted or your account is deleted, except for copies already made through an offered copy function, temporary backup copies removed in the ordinary backup cycle, and retention required by law or needed to establish, exercise, or defend legal claims.

Your username and painter profile are public by default. Optional profile details appear publicly only when you add them. Paints in your collection and your recipes and projects remain private unless a feature clearly says otherwise; recipes and projects become public only when you use the relevant publish action. Public profiles and published projects or recipes can be viewed by people without a Paintdeck account and may be indexed, linked to, or captured by third parties outside our control.

Public profiles, projects, recipes, text, and images must follow the Community Guidelines. Ordinary miniature-painting depictions of fantasy, horror, historical warfare, weapons, monsters, or painted battle damage are allowed in their hobby context unless they otherwise cross those rules.

You can unpublish content through the functions Paintdeck provides. This stops Paintdeck from presenting the source publicly after processing the request, but cannot recall copies, screenshots, search caches, or links already made by others outside our control.

When you add or change public-facing profile content or publish or republish a recipe or project, automated screening may publish it, hold it for administrator review or retry, or reject an exceptionally clear violation. An approved version can remain public while an edit is checked. Automated screening alone does not suspend or ban an account.

People can report allegedly unlawful or rule-breaking public content, and signed-in painters can block other painters. After review, we may take no action, reject a pending publication, unpublish a specific item while preserving its private source, or restrict an account from further publishing. We consider context, severity, frequency, relevant history, and whether a less restrictive measure is sufficient. Severe or repeated violations and attempts to evade decisions may justify stronger action.

The Community Guidelines explain prohibited content, automated and human review, legal and intellectual-property notices, and the free appeal process. Affected painters can request review of a screening, unpublishing, or publishing-restriction decision within six months. See the Community Guidelines for the procedure and contact details. Mandatory legal remedies remain unaffected.

Paintdeck's software, design, branding, documentation, and operator-provided content are protected by intellectual-property and other laws. Subject to these Terms, you receive a personal, non-exclusive, non-transferable, limited right to use the service for its intended purpose while your contract remains active. No ownership rights are transferred to you.

You may not copy, sell, sublicense, publicly redistribute, or modify protected parts of Paintdeck, or reverse engineer the application, except where a function expressly permits it or mandatory law allows it. Paint names, manufacturers, logos, and other third-party material remain the property of their respective owners. Their appearance in a catalogue does not imply sponsorship or affiliation.

We aim to keep Paintdeck available and secure but do not promise uninterrupted or error-free operation. Maintenance, security incidents, provider outages, legal requirements, or events outside reasonable control can temporarily limit the service. This does not limit any mandatory right to performance, remedies, or necessary updates.

We may update or change the free service for valid reasons such as improving functions, security or accessibility; adapting to technical environments or usage; preventing abuse; or complying with law. Changes do not create additional charges under the current free contract. We will explain material changes clearly. If a change materially impairs access or use, we will give reasonable advance notice on a durable medium and explain any termination or other rights required by law.

Security and other updates needed to keep the digital service in conformity will be provided for the period required by applicable law. You are responsible for installing application and operating-system updates made available to you within a reasonable time after being informed of them and of the consequences of not installing them.

You may terminate the contract at any time without notice by permanently deleting your account in the Account Actions section of your profile. You may also contact us from your account email address. Account deletion is permanent and removes associated content and account data subject to the limited retention described in the Privacy Notice.

We may terminate the free contract with at least 30 days' notice. We may suspend access or terminate without notice for good cause, including a severe breach, repeated violations after warning where a warning is reasonable, a security threat, fraud, or a legal requirement. We will consider the circumstances and use a less restrictive measure where reasonable. Notice or an opportunity to remedy may be omitted where urgent action is necessary, prohibited by law, or unreasonable in the circumstances.

If Paintdeck is discontinued, we will normally give at least 30 days' notice so you can secure information you wish to keep, unless urgent legal, security, insolvency, or other circumstances outside reasonable control prevent this. Rights and obligations that by their nature continue after termination—including rights concerning existing authorised copies, liability, and legal retention—remain effective.

Withdrawal instructions

If you are a consumer and the statutory right of withdrawal applies to your contract, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise the right of withdrawal, you must inform Kurt Gierke, Hämmerlingstr. 136, 12555 Berlin, Germany, email: mail@paintdeck.net, of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but it is not obligatory. You can also use the electronic withdrawal function.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs except additional costs resulting from a delivery method you selected that was more expensive than the least expensive standard delivery offered by us. We will reimburse you without undue delay and no later than fourteen days after receiving your withdrawal notice, using the same payment method as the original transaction unless expressly agreed otherwise; you will not incur fees for the reimbursement. Paintdeck is currently provided without charge, so no payment is normally due for reimbursement.

The Paintdeck contract and account end when the withdrawal takes effect. We will stop providing the service and delete the account and associated data, subject to statutory retention duties, the limited exceptions explained in the Privacy Notice, and mandatory rights concerning content you supplied. Please save content you wish to keep before confirming electronic withdrawal or contact us promptly if you need content made available to you under applicable law.

We are liable without limitation for intent and gross negligence; for injury to life, body, or health; under the German Product Liability Act; for a guarantee expressly given; for fraudulent concealment; and wherever liability cannot lawfully be limited.

For ordinary negligence, we are liable only for breach of a material contractual obligation whose fulfilment makes proper performance possible and on which you can ordinarily rely. In that case, liability is limited to damage typical for the contract and reasonably foreseeable when the contract was formed. These limitations also apply for the benefit of our legal representatives and agents. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law.

You remain responsible for keeping copies of content that is important to you where this is reasonably possible. We are not responsible for third-party content or services merely because Paintdeck displays or links to them; this does not affect duties that applicable law places on us after we become aware of unlawful content.

We may propose changes to these Terms for valid reasons, including changes to Paintdeck, law, security requirements, or moderation procedures. The version and effective date at the top identify the current Terms. We will communicate material changes in advance in a clear manner and on a durable medium where required. If consent is legally required, we will ask for it; silence does not constitute consent unless applicable law permits this and its requirements are met. You may terminate your account at any time.

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually reside. Statutory rules determine the competent courts; these Terms do not require a consumer to bring a claim only in Germany.
